Bu Kullanım Koşulları (“Koşullar”), Asre Bilişim Sistemleri (“Asre Digital” ticari adıyla; “Postinpro”, “biz”) tarafından işletilen postinpro.com adresindeki Postinpro sosyal medya yönetimi ve içerik planlama platformuna (“Hizmet”) erişiminizi ve kullanımınızı düzenler. Bir hesap oluşturarak veya Hizmeti kullanarak bu Koşulları ve Gizlilik Politikamızı kabul etmiş olursunuz.

1.Koşulların kabulü

Bu Koşulları kabul etmiyorsanız Hizmeti kullanmayın. Hizmeti bir kurum adına kullanıyorsanız, o kurumu bağlama yetkiniz olduğunu beyan edersiniz ve “siz” ifadesi ilgili kurumu kapsar.

2.Tanımlar

• Hesap — Hizmet üzerindeki kayıtlı kullanıcı hesabınız.
• İçerik — Hizmet aracılığıyla oluşturduğunuz, yüklediğiniz, planladığınız veya yayınladığınız metin, görsel, video, açıklama ve diğer materyaller.
• Bağlı Hesap — Hizmete bağladığınız üçüncü taraf sosyal medya hesabı.
• Abonelik — Hizmetin özelliklerine erişim sağlayan ücretli plan.

3.Hizmet

Postinpro; bağlı sosyal medya hesaplarında içerik oluşturmanıza, planlamanıza, yayınlamanıza, yönetmenize ve analiz etmenize, ekip üyeleriyle iş birliği yapmanıza ve isteğe bağlı yapay zekâ destekli içerik araçlarını kullanmanıza yardımcı olan bir yazılım hizmeti (SaaS) platformudur. Özellikler plana göre değişebilir ve zaman içinde değiştirilebilir.

4.Uygunluk

Hizmeti kullanmak için en az 18 yaşında ve sözleşme yapma ehliyetine sahip olmanız gerekir. Ayrıca bağladığınız her üçüncü taraf platformun koşullarına da uymanız gerekir.

5.Hesap ve güvenlik

Kayıt bilgilerinizin doğruluğundan, giriş bilgilerinizin gizliliğini korumaktan ve Hesabınız altındaki tüm faaliyetlerden siz sorumlusunuz. Yetkisiz bir kullanım fark ederseniz derhâl [email protected] adresinden bize bildirin. Ele geçirilmiş görünen veya bu Koşulları ihlal eden hesapları askıya alabiliriz.

6.Abonelik, faturalandırma ve ödeme

Bazı özellikler ücretli Abonelik gerektirir. Fiyatlar ve plan ayrıntıları satın alma sırasında gösterilir ve geçerli vergiler (KDV dâhil) hariç olabilir; bu vergiler gerektiğinde eklenir.

• Ödeme sağlayıcıları. Ödemeler iyzico ve PayTR tarafından işlenir. Abone olarak, bizi ve sağlayıcılarımızı seçtiğiniz ödeme yönteminden tahsilat yapmaya yetkilendirirsiniz.
• Yenileme. Abonelikler, yenileme tarihinden önce iptal edilmedikçe aynı süre için otomatik olarak yenilenir. Abone olarak, iptal edene kadar tekrarlayan tahsilatları onaylarsınız.
• Fiyat değişiklikleri. Fiyatları değiştirebiliriz; değişiklikler bir sonraki fatura döneminizden itibaren geçerli olur ve makul bir süre önceden bilgi veririz.
• Başarısız ödemeler. Bir ödeme başarısız olursa, ödenmemiş tutar tahsil edilene kadar erişiminizi askıya alabilir veya sınırlandırabiliriz.

7.İptal, iade ve cayma hakkı

Aboneliğinizi hesap ayarlarınızdan dilediğiniz zaman iptal edebilirsiniz. İptal, gelecekteki yenilemeleri durdurur; mevcut ücretli döneminizin sonuna kadar erişiminiz devam eder.

8.Kabul edilebilir kullanım

Hizmeti şu amaçlarla kullanmamayı kabul edersiniz:

• herhangi bir kanunu veya bağlı üçüncü taraf platformun koşullarını, politikalarını ya da API kurallarını ihlal etmek;
• hukuka aykırı, hak ihlali oluşturan, karalayıcı, aldatıcı, nefret içeren, taciz edici, müstehcen veya çocukları istismar eden/tehlikeye atan içerik paylaşmak;
• spam göndermek ya da aldatıcı, hileli veya manipülatif etkileşim uygulamalarında bulunmak;
• zararlı yazılım yaymak veya Hizmeti bozmaya, ele geçirmeye, aşırı yüklemeye ya da tersine mühendislik yapmaya çalışmak;
• sunduğumuz özelliklerin ötesinde otomatik yöntemlerle Hizmete erişmek veya yetkisiz veri kazımak (scraping);
• üçüncü kişilerin fikrî mülkiyet, gizlilik veya diğer haklarını ihlal etmek;
• iznimiz olmadan Hizmeti yeniden satmak, alt lisanslamak veya yanlış tanıtmak.

İçeriğinizden ve İçeriğinizin bu Koşullara ve kullandığınız her platformun kurallarına uygunluğundan yalnızca siz sorumlusunuz.

9.Üçüncü taraf platformlar ve API’ler

Hizmet, üçüncü taraf sosyal medya platformlarıyla API’leri üzerinden entegre olur. Bu platformlarla bağlantılı, onlar tarafından onaylanmış değiliz ve onlardan sorumlu değiliz. Bu platformlar API’lerini istedikleri zaman değiştirebilir, sınırlayabilir, askıya alabilir veya sonlandırabilir; bu da Hizmetin işlevselliğini önceden haber vermeksizin etkileyebilir. Her Bağlı Hesabı kullanmanız ilgili platformun kendi koşullarına tabidir.

10.Yapay zekâ özellikleri

İsteğe bağlı yapay zekâ özellikleri, girdilerinize dayalı içerik üretmek için üçüncü taraf sağlayıcıları (OpenAI ve Google Gemini) kullanır. Yapay zekâ çıktısı hatalı, eksik veya uygunsuz olabilir ve hiçbir garanti verilmeksizin sunulur. Üretilen içeriği gözden geçirmekten, nasıl kullandığınızdan ve bunun geçerli yasalara ve platform kurallarına uygunluğundan siz sorumlusunuz. Gönderdiğiniz girdiler, Gizlilik Politikamızda açıklandığı şekilde ilgili yapay zekâ sağlayıcısıyla paylaşılır.

11.İçeriğiniz ve lisans

İçeriğinizin mülkiyeti sizde kalır. Hizmeti işletmek ve sunmak için gerekli olduğu ölçüde İçeriğinizi barındırmak, saklamak, çoğaltmak, iletmek, (biçimlendirme amacıyla) uyarlamak ve seçtiğiniz platformlara yayınlamak üzere bize sınırlı, dünya çapında, münhasır olmayan ve telifsiz bir lisans verirsiniz. İçeriğinizi yayınlamak ve bu lisansı vermek için gerekli tüm haklara sahip olduğunuzu beyan edersiniz.

12.Fikrî mülkiyet

Yazılımı, tasarımı, ticari markaları ve “Postinpro” markası dâhil olmak üzere Hizmet, bize veya lisans verenlerimize aittir ve yasalarla korunur. Bu Koşullar kapsamında Hizmeti kullanmanız için size sınırlı, münhasır olmayan ve devredilemez bir hak tanırız. İzin verilen durumlar dışında Hizmeti kopyalayamaz, değiştiremez, dağıtamaz veya türev çalışmalar oluşturamazsınız.

13.Ortaklık ve tavsiye programları

Bir ortaklık (affiliate) veya tavsiye programı sunmamız hâlinde ek program koşulları uygulanır. Komisyonlar, ödemeler ve uygunluk bu koşullara ve onayımıza tabidir; bu programları dilediğimiz zaman değiştirebilir veya sonlandırabiliriz.

14.Erişilebilirlik ve değişiklikler

Hizmeti erişilebilir tutmayı amaçlarız ancak kesintisiz veya hatasız çalışmayı garanti etmeyiz. Özellikleri dilediğimiz zaman değiştirebilir, askıya alabilir veya sonlandırabilir ya da bakım yapabiliriz. Bundan kaynaklanan erişilemezlikten sorumlu değiliz.

15.Feragatnameler

Hizmet, açık veya zımni hiçbir garanti olmaksızın “olduğu gibi” ve “mevcut olduğu şekliyle” sunulur; belirli bir amaca uygunluk, satılabilirlik, hak ihlali oluşturmama veya içeriğin herhangi bir üçüncü taraf platform tarafından yayınlanacağı, iletileceği ya da görüntüleneceği garantileri dâhil. Belirli bir sonuç, erişim, etkileşim veya çıktı garanti etmeyiz.

16.Sorumluluğun sınırlandırılması

Yürürlükteki hukukun izin verdiği azami ölçüde; Hizmeti kullanmanızdan veya kullanamamanızdan doğan dolaylı, arızi, özel, netice kabilinden veya cezai zararlardan ya da kâr, veri, itibar veya iş kaybından sorumlu olmayacağız. Hizmete ilişkin herhangi bir talep bakımından toplam sorumluluğumuz, talebe yol açan olaydan önceki on iki (12) ay içinde Hizmet için bize ödediğiniz tutarla sınırlıdır. Bu Koşullardaki hiçbir hüküm, yürürlükteki hukuk uyarınca sınırlandırılamayacak sorumluluğu sınırlandırmaz.

17.Tazminat

İçeriğinizden, Hizmeti kullanmanızdan ya da bu Koşulları veya üçüncü kişi haklarını ya da platform koşullarını ihlal etmenizden doğan her türlü talep, zarar, kayıp veya masrafa (makul avukatlık ücretleri dâhil) karşı Postinpro’yu ve Asre Bilişim Sistemleri’ni, yöneticilerini, çalışanlarını ve iş ortaklarını tazmin etmeyi ve zarardan âri tutmayı kabul edersiniz.

18.Askıya alma ve fesih

Hizmeti kullanmayı dilediğiniz zaman bırakabilir ve Hesabınızı silebilirsiniz. Bu Koşulları ihlal etmeniz, risk veya hukuki sorumluluk yaratmanız ya da ödeme yapmamanız hâlinde erişiminizi bildirimli veya bildirimsiz olarak askıya alabilir veya sonlandırabiliriz. Fesih hâlinde Hizmeti kullanma hakkınız sona erer; niteliği gereği geçerliliğini sürdürmesi gereken hükümler (mülkiyet, feragatnameler, sorumluluk sınırları ve tazminat dâhil) uygulanmaya devam eder.

19.Uygulanacak hukuk ve uyuşmazlık çözümü

Bu Koşullar, kanunlar ihtilafı kurallarına bakılmaksızın Türkiye Cumhuriyeti hukukuna tabidir. Uyuşmazlıklarda Bursa Mahkemeleri ve İcra Daireleri yetkilidir; emredici tüketici koruma mevzuatının size başka haklar tanıdığı hâller saklıdır. Türkiye’deki tüketiciler ayrıca yetkili Tüketici Hakem Heyetlerine veya Tüketici Mahkemelerine başvurabilir.

20.Koşullardaki değişiklikler

Bu Koşulları zaman zaman güncelleyebiliriz. Önemli değişiklikler yaptığımızda “Son güncelleme” tarihini değiştirir ve uygun olduğu durumlarda sizi bilgilendiririz. Değişiklikler yürürlüğe girdikten sonra Hizmeti kullanmaya devam etmeniz, güncellenmiş Koşulları kabul ettiğiniz anlamına gelir.

21.Çeşitli hükümler

Bu Koşullar, Gizlilik Politikamızla birlikte, Hizmete ilişkin olarak sizinle bizim aramızdaki tüm sözleşmeyi oluşturur. Herhangi bir hükmün uygulanamaz olduğu tespit edilirse, kalan hükümler geçerliliğini korur. Bir hakkı kullanmamamız ondan feragat ettiğimiz anlamına gelmez. Bu Koşulları iznimiz olmadan devredemezsiniz; biz ise birleşme, devralma veya varlık satışı kapsamında devredebiliriz. Makul kontrolümüz dışındaki olaylardan (mücbir sebep) kaynaklanan aksaklıklardan sorumlu değiliz. Size yapılacak bildirimler e-posta yoluyla veya Hizmet üzerinden yapılabilir.

These Terms of Use (“Terms”) govern your access to and use of the Postinpro social media management and scheduling platform at postinpro.com (the “Service”), operated by Asre Bilişim Sistemleri, trading as “Asre Digital” (“Postinpro”, “we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

1.Agreement to Terms

If you do not agree to these Terms, do not use the Service. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation, and “you” refers to that organisation.

2.Definitions

• Account — your registered user account on the Service.
• Content — text, images, videos, captions and other material you create, upload, schedule or publish through the Service.
• Connected Account — a third-party social media account you link to the Service.
• Subscription — a paid plan giving access to features of the Service.

3.The Service

Postinpro is a software-as-a-service platform that helps you create, schedule, publish, manage and analyse content across connected social media accounts, collaborate with team members, and use optional AI-assisted content tools. Features may vary by plan and may change over time.

4.Eligibility

You must be at least 18 years old and legally able to enter into a contract to use the Service. You must also comply with the terms of any third-party platform you connect.

5.Accounts and security

You are responsible for the accuracy of your registration information, for keeping your login credentials confidential, and for all activity under your Account. Notify us immediately at [email protected] of any unauthorised use. We may suspend accounts that appear compromised or that violate these Terms.

6.Subscriptions, billing and payment

Certain features require a paid Subscription. Prices and plan details are shown at the point of purchase and may be exclusive of applicable taxes (including Turkish VAT/KDV), which will be added where required.

• Payment providers. Payments are processed by iyzico and PayTR. By subscribing, you authorise us and our providers to charge your chosen payment method.
• Renewals. Subscriptions renew automatically for the same period unless cancelled before the renewal date. By subscribing, you authorise recurring charges until you cancel.
• Price changes. We may change prices; changes apply from your next billing cycle and we will give reasonable prior notice.
• Failed payments. If a payment fails, we may suspend or downgrade your access until the amount due is paid.

7.Cancellation, refunds and right of withdrawal

You may cancel your Subscription at any time from your account settings. Cancellation stops future renewals; you keep access until the end of your current paid period.

8.Acceptable use

You agree not to use the Service to:

• violate any law or the terms, policies or API rules of any connected third-party platform;
• post or distribute content that is unlawful, infringing, defamatory, deceptive, hateful, harassing, obscene, or that exploits or endangers minors;
• send spam or engage in deceptive, fraudulent or manipulative engagement practices;
• transmit malware or attempt to disrupt, hack, overload or reverse-engineer the Service;
• access the Service by automated means beyond our provided features, or scrape data without authorisation;
• infringe intellectual property, privacy or other rights of third parties;
• resell, sublicense or misrepresent the Service without our permission.

You are solely responsible for your Content and for ensuring it complies with these Terms and with the rules of each platform you use.

9.Third-party platforms and APIs

The Service integrates with third-party social media platforms through their APIs. We are not affiliated with, endorsed by, or responsible for those platforms. They may change, limit, suspend or discontinue their APIs at any time, which can affect the Service’s functionality without notice. Your use of each Connected Account remains subject to that platform’s own terms.

10.AI features

Optional AI features use third-party providers (OpenAI and Google Gemini) to generate content based on your inputs. AI output may be inaccurate, incomplete or unsuitable, and is provided without warranty. You are responsible for reviewing and for how you use any AI-generated content, and for ensuring it complies with applicable laws and platform rules. Inputs you submit are shared with the relevant AI provider as described in our Privacy Policy.

11.Your Content and licence

You retain ownership of your Content. You grant us a limited, worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transmit, adapt (for formatting) and publish your Content solely as necessary to operate and provide the Service, including delivering it to the platforms you choose. You represent that you have all rights necessary to grant this licence and to publish your Content.

12.Intellectual property

The Service, including its software, design, trademarks, and the “Postinpro” brand, is owned by us or our licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms. You may not copy, modify, distribute or create derivative works of the Service except as permitted.

13.Affiliate and referral programs

If we offer an affiliate or referral program, additional program terms will apply. Commissions, payouts and eligibility are subject to those terms and to our approval; we may modify or discontinue such programs at any time.

14.Availability and modifications

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue features, or perform maintenance, at any time. We are not liable for any resulting unavailability.

15.Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, non-infringement, or that content will be published, delivered or displayed by any third-party platform. We do not guarantee any particular results, reach, engagement or outcome.

16.Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or business, arising from your use of or inability to use the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be excluded under applicable law.

17.Indemnification

You agree to indemnify and hold harmless Postinpro and Asre Bilişim Sistemleri, its officers, employees and partners from any claims, damages, losses or expenses (including reasonable legal fees) arising from your Content, your use of the Service, or your breach of these Terms or of any third-party rights or platform terms.

18.Suspension and termination

You may stop using the Service and delete your Account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, create risk or legal exposure, or fail to pay. On termination, your right to use the Service ends; sections that by their nature should survive (including ownership, disclaimers, liability limits and indemnities) will continue to apply.

19.Governing law and dispute resolution

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. The Courts and Enforcement Offices of Bursa shall have jurisdiction over disputes, except where mandatory consumer-protection law grants you other rights. Consumers in Türkiye may also apply to the competent Consumer Arbitration Committees (Tüketici Hakem Heyetleri) or Consumer Courts.

20.Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

21.Miscellaneous

These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remainder stays in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. We are not liable for failures caused by events beyond our reasonable control (force majeure). Notices to you may be given by email or through the Service.
